Terms and Conditions
These terms and conditions set out the basis on which surroundpix.com.au Ltd ("we", "us" or "our") provides its photograph and virtual tour services ("Services") to real estate agents ("you").
1 We will confirm all booking details with you prior to attending any appointment.
2 If you cancel the Services before 4pm on the day before your appointment, no fee will be incurred. If you cancel the Services after 4pm on the day before your appointment, you will be charged at 50%.
3 All fees for the Services are inclusive of GST.
4 Where a layout contains complex or unusual properties, we may in our absolute discretion charge additional fees. Any additional fee will be advised
to you prior to us undertaking the Services.
5 Where properties are located outside a 50km radius of Sydney's CBD, fees for travel time will be charged at $0.88 per kilometer.
6 We will invoice you within 14 days of completion of the Services.
7 Payment must be made in accordance with the terms of the invoice.
8 We retain ownership of all intellectual property and other rights in any materials or photographs produced or created by us during the provision of the
Services. We grant you an irrevocable, royalty free license to use those materials in all media throughout the world for promotional purposes only.
9 Whilst we take all reasonable steps to deliver the order within the agreed timeframe of 48 hours, our liability for any loss or damage incurred by
you as a result of the order not being fulfilled shall be limited to the cost of the specific individual product or services.
10 You agree to inspect all services and/or products and notify us of any defects within 5 working days of the creation of the services and/or products,
failing which we will have no liability for any defects.
11 You will allow us 2 working days to remedy any defects or problem once we are notified in writing of the defect.
12 Nothing in this agreement limits any right or remedy you may have under applicable legislation, which may include the Trade Practices Act 1974 (Cth)
and similar state or territory legislation which contains provisions to protected the purchase of goods and services in certain circumstances.
